Terms of Service

1. Who operates Nexuna

This website and the Nexuna client portal are operated by Nexuna Development Team (“Nexuna”, “we”, “us”), an unregistered development team based in Latvia. Support, order questions and legal or privacy requests are handled through the Discord ticket system linked from the contact page.

2. What Nexuna offers

Nexuna builds and sells digital services and products, which may include websites, web applications, Discord bots and hosting setup, Roblox experiences, community-economy features, partnerships and other digital deliverables. Availability can change. A service description on this website is an invitation to request a quote unless the item is published as an orderable fixed-price product in the live catalogue.

3. Quotes, orders and acceptance

• For custom work, the deliverables, price, payment schedule, timeline, revision/support scope and required client inputs must be confirmed in writing through a Discord ticket, the portal, or another written channel we accept.
• Do not pay for custom work until you have accepted that written scope. A verbal estimate is not a fixed quote.
• For fixed-price catalogue items, the product name, included features and server-calculated total shown in the Client Portal or Discord /shop at checkout are authoritative.
• We may decline or stop work that is illegal, infringing, abusive, unsafe, impossible with the provided access/materials, or in breach of Discord, Roblox, Stripe or another applicable platform's rules.
• If an obvious pricing or listing error occurs, we may cancel the affected order before delivery and handle any amount already paid under the Refund Policy and applicable law.

4. Accounts and Discord login

Portal access uses Discord OAuth with the identify scope. You are responsible for your Discord account and for activity performed while signed in. Your portal role is verified server-side; do not attempt to access customer, staff or owner functions you are not authorised to use.

5. Prices and payment

• Prices are shown in euros (EUR) unless a product expressly states another currency. The final server-calculated amount at checkout is the amount charged.
• Card payments are processed and secured by Stripe. Nexuna does not receive or store your full card number.
• Some products can be purchased with Nexuna Pennies (“NP”). NP is a closed-loop, in-community utility balance. It is not cash, electronic money, a bank deposit, cryptocurrency, an investment or a promise of return, and it cannot be cashed out through Nexuna.
• Partnership discounts apply only while the relevant partnership and discount-slot eligibility are active and are rechecked for each new order.
• Unpaid, abandoned or failed checkouts do not create an order.

6. Delivery and client responsibilities

Digital delivery may occur through Discord, the portal, source-code/file transfer, deployment to an agreed server, or access to a configured service. Timelines are estimates unless a written quote expressly guarantees a date. You must provide accurate requirements, assets, credentials/access and timely feedback. Delays caused by missing inputs or third-party platforms can move delivery.

Please test deliverables promptly and report defects through a support ticket with reproducible steps. Nexuna will address defects that fall within the accepted scope. New features and changes outside that scope may require a new quote.

7. AI-accelerated development

Nexuna uses AI tools as part of its development process. Work is checked against the agreed scope before handover, but AI-assisted output can still contain errors. You remain responsible for reviewing deliverables for your business, legal, security and platform-specific requirements before production use, especially where professional advice is required.

8. Intellectual property

• You keep ownership of materials you provide and confirm you have the right to use them.
• Subject to full payment and any written quote, you receive the rights needed to use the custom deliverables created for your project.
• Pre-existing Nexuna tools, libraries, frameworks, templates, know-how and third-party/open-source components remain owned by their respective owners and are licensed as necessary for the deliverable to function.
• Nexuna will not publish private source code, credentials or non-public deliverables as a portfolio item without permission.

9. Acceptable use

You must not use Nexuna services for malware, fraud, spam, credential theft, unlawful surveillance, copyright/trademark infringement, harassment, evasion of platform safeguards, or another unlawful or abusive purpose. We may suspend access or delivery where continued service would create legal, security or platform risk.

10. Availability and third parties

Nexuna aims to keep its website, portal and hosted systems available, but no online service can promise zero downtime. Discord, Stripe, Cloudflare, hosting, network and game/platform outages can affect availability. Any special support period or service level must be written into your accepted quote.

11. Liability

To the extent permitted by law, Nexuna's aggregate liability for a paid service is limited to the amount paid for that affected service. Nexuna is not liable for indirect or unforeseeable losses, third-party platform decisions, or loss caused by inaccurate client inputs or unauthorised changes after handover. These limits do not apply where liability cannot be limited by law, including fraud or personal injury caused by negligence.

12. Withdrawal, cancellation and refunds

Please read the Refund Policy. Contact us as soon as possible—and, to protect any time-limited consumer right, within 14 days where relevant—through a Discord support ticket. Nexuna's voluntary refund method is a Nexuna Pennies credit; mandatory consumer remedies remain governed by applicable law.

13. Changes and governing law

We may update these terms for legal, security or operational reasons. The version effective for an order is normally the version published when the order was accepted, unless a later change is required by law or expressly accepted. Latvian law governs these terms, without removing mandatory consumer protection available in your country of residence.
